PUBLIC OFFER AGREEMENT (BOOKING AND SERVICE TERMS)
This document is an official proposal (public offer) from IE "KAZAKHSTAN TRAVEL
AGENCY" (hereinafter — the "Provider") to any individual or legal entity (hereinafter — the
"Customer") that accepts this offer under the conditions specified below.
In accordance with Article 395 of the Civil Code of the Republic of Kazakhstan (RK),
unconditional acceptance of the terms of this public offer is defined as the Customer making
a partial or full prepayment for tourism services via an individual link (invoice) generated by
the Provider and sent to the Customer via email or messenger services.
SUBJECT OF THE AGREEMENT
1.1. The Provider undertakes, at the request of the Customer, to organize and provide
tourism services (including, but not limited to: individual jeep tours, sightseeing programs,
off-road vehicle transport) along an agreed route in the Republic of Kazakhstan, as well as
adjacent routes in the Kyrgyz Republic and the Republic of Uzbekistan, and the Customer
undertakes to pay for these services under the terms of this Agreement.
1.2. Descriptions of basic tour programs and possible locations are presented on the
Provider's Website, however, each final route is formed individually based on the Customer's
requests.
PAYMENT, BOOKING, AND SETTLEMENT PROCEDURE
2.1. All of the Provider’s jeep tours are individual. The final route, schedule, list of included
services, and total cost of the tour are calculated by the Provider personally for each
Customer after preliminary coordination.
2.2. After the individual program and tour cost are approved by the Customer, the Provider
generates a personal payment link (electronic invoice) via the TipTop Pay payment system
and sends it to the Customer.
2.3. To finalize the booking of a jeep tour and secure the dates, the Customer must make a
prepayment of 30% of the total estimated tour cost via the provided link within 3 banking
days from the moment of receipt.
2.4. The remaining 70% of the tour cost shall be paid by the Customer in cash directly on the
first day of the tour before departure.
2.5. All non-cash payments via individual links are accepted in the national currency of the
Republic of Kazakhstan — tenge (KZT). International clients pay the invoice using
Visa/Mastercard cards in their own currency, with automatic conversion to tenge at the
exchange rate of the Customer's issuing bank at the time of the transaction.
RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. The Provider shall:
Ensure the provision of services in strict accordance with the agreed individual tour program.
Provide prepared and functional off-road vehicles, as well as qualified driver-guides.
Inform the Customer about safety rules while in difficult terrain, mountainous, or steppe
sections of the route.
3.2. The Customer shall:Provide accurate passport and contact details for all tour participants (including data for
processing border permits and travel insurance, if provided for by the route).
Observe safety rules inside the vehicle and at stops, and treat the Provider's expedition
equipment with care.
Respect the laws, culture, and customs of the countries visited.
CANCELLATION AND REFUND POLICY
4.1. In the event of a cancellation by the Customer, the refund of the prepayment made via
the link shall be issued minus the Provider's actual incurred expenses that cannot be
canceled (including, but not limited to: non-refundable hotel/guesthouse bookings, expenses
for purchasing supplies, and fees for permits to enter national parks or border zones).
4.2. If the Customer cancels the tour less than 7 days before its start, the non-cash
prepayment is retained by the Provider in full as a penalty for the loss of the vehicle and
crew booking.
4.3. Refunds of the prepayment are made exclusively to the same bank card used for the
payment via the TipTop Pay system within 5-10 banking days. No refunds are provided for
the cash portion of the payment if it has not yet been paid.
FORCE MAJEURE AND LIABILITY
5.1. The parties are exempt from liability for partial or complete non-fulfillment of obligations
if it is the result of force majeure circumstances: natural disasters (mudslides, rockfalls,
washed-out roads), sudden weather changes in mountainous areas making jeep travel
dangerous for passenger life, or the closure of state borders or public roads by government
order.
5.2. The Provider is not responsible for changes in the tour schedule caused by delays at
border and customs control between the Republic of Kazakhstan, the Kyrgyz Republic, and
the Republic of Uzbekistan.
